Scuff marks during repair

The consumer’s issue:

“My car, which is only four and half years old, and which has less than 20,000 miles on the clock, had a speed sensor issue. The problem was resolved, but some damage to my front bumper that was already severely scuffed, was caused to my car whilst it was in the garage to be fixed. I am becoming more and more frustrated at the complete inability of the service centre to accept that it is near impossible that the additional damage was not caused by them.

Furthermore, when I picked the car up, I noticed fresh chalky scuff marks which easily rubbed off with my finger, and below them, the paint was damaged. It therefore seems to me that these must have been caused after the car was cleaned at the service centre, I have sent a photo to the garage that I took when I collected my car, and they have told me twice that photos were taken of the car shortly after I left it with them. But when I have asked for copies they have strangely been unable to get hold of them.”      

The accredited business’ response:

  • We can confirm that, whilst we do not accept responsibility for the damage to the vehicle, we believe that it was not caused by us.
  • However, as the video we had taken of the vehicle was after the vehicle was cleaned, we have agreed to repair and cover the cost of the damage.

The adjudication outcome:

  • The adjudicator agreed with the offer from the business and the consumer was also happy with outcome, thereby closing the case.
